The Demise of the 28-Clause Ceasefire Plan for Ukraine: Why Diplomatic Efforts Continue to Falter

Europe felt a moment of respite on Monday, as the crisis caused by the presentation of a new comprehensive peace framework for achieving ceasefire appeared – briefly – to have been defused. A senior US official spoke of "significant advancement" after diplomatic discussions in Geneva. On Monday night, Moscow made its retaliation: a renewed assault of aerial bombardment on Kyiv.

The Rhythm of Negotiation and Warfare

The succession of conflicting incidents captured the grim essence of the recent timeframe. By day, diplomatic battles are waged: positive announcements are delivered from different nations. Considerable effort is devoted on restraining certain initiatives. By night, the Kremlin forcefully demonstrates the world that, for them, war remains the primary tool for achieving "peace".

Nocturnal Warfare

As military strikes unfolded into the early hours of Tuesday, the immediate reality of Ukraine's defenselessness was exposed. Ukraine is capable of detecting projectile deployments from Russian territory, a ability enabled by current data. From vantage locations, Ukrainian air force fighter jets that had been dispatched to intercept incoming guided weapons roared overhead – sophisticated military planes delivered to Ukraine by European allies.

Soon thereafter, Kyiv's anti-aircraft weapons thundered: defensive missiles deployed against a Russian ballistic missile. This was a sophisticated defense system at work, probably provided by Western nations. Every deployment jolts you unexpectedly, rattling buildings. The moment of terror quickly gives way to resigned acknowledgment: possibly the approaching threat won't hit its mark this time, protecting urban areas from catastrophe and additional electricity failures.

Persistent Threats

Not long after, a heavy machine gun engaged a aerial vehicle in the vicinity, part of a defensive team – most likely imported technology. Unfortunately, the shots failed to hit the hostile drone – it continued its flight toward its objective.

With pauses, this continued until dawn. Kyiv greeted the morning news: multiple fatalities, devastation and heating outages in multiple buildings as a result of the nocturnal offensive. As typically, everyone still went about their day – enduring hostilities. But those entire period demonstrated Ukraine's vital need on external assistance – a dependence that neighboring countries are evidently unprepared to replace in the immediate future.

Unsuccessful Negotiations

The 28-point plan from Washington generated strong feelings, debate and serious worry – and temporarily diverted attention from Ukraine's largest corruption scandal in years. Yet, we have witnessed similar scenarios, after prior negotiation attempts and international summits.

Every new initiative from US leadership follows the consistent cycle: a diplomatic cavalry charge against Ukraine, which Kyiv, with other European capitals, succeeds in resisting. They contain the crisis but never actually win the battle. This cycle will, no doubt, persist.

Strategic Calculations

It is convenient to criticize particular leaders of persistently promoting Moscow's conditions. But that does not seem to be the complete picture. Washington functions according to a premise familiar among seasoned negotiators: you cannot win at the negotiating table what you have been unable to protect through force. The US administration presumes that it is unfeasible to compel Moscow to relinquish the land that it already controls in Ukraine's southern or eastern regions.

The challenge is that while acknowledging this situation, US leadership does minimal to prevent Kremlin actions, through words or deeds, from thinking that the status quo will not change more in its favour in the near future.

Conflicting Perspectives

Therefore, the Kremlin is certain that the clock favors them – that Ukraine and its supporters are coming close to fatigue. Their motivation to agree to terms that does not give them the maximum possible gain is almost completely absent. There may be many attempts to achieve ceasefire, but they will continue as long as Russia's leader remains completely certain in the result.

On the contrary, Kyiv believes that Ukraine can still endure, slowly losing people and territory but avoiding a complete military breakdown until conditions improve in its favour.

Current Realities

Factually, there are no actual prerequisites for a armistice. Now, individual motivations are coming into play: political desires to broker a ceasefire and secure international recognition, and Ukrainian leadership's dual difficulties – on one hand, not to estrange crucial supporters, and on the other, to mobilize citizens around the flag against any plan Kyiv finds unworkable, so that their priority does not switch to homefront challenges. And although their task will now be considerably more difficult after recent developments, it remains quite doubtful that this will modify their basic position.

These opposing factors are driving the talks.

Conclusion and Outlook

It took a only one week to eliminate the proposed articles of the most recent proposal. Assertive and inconsistent approach of the matter by US administration, resistance by Ukraine and the other European countries, along with pacifying measures of negotiators, and finally, current information leaks, all did their job.

While new initiatives based on old ideas are approaching, Kyiv, London and other allied nations should reach an essential realization: Ukraine and Europe will only be able to resist political attacks from Washington that are rooted in Kremlin requirements and demonstrate particular unwillingness to alter the situation, if they maintain solidarity and improve their protective measures at a much faster pace. If they do, neither external pressure nor military threats will be able to defeat them. In the meantime, Ukraine's capability to defend against evening bombardments will, for the predictable period, largely rely on sustained allied backing.
